1. Agreement to Terms

By accessing or using Bugfeed's services, including our website, Chrome extension, and embeddable widget (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Bugfeed provides a visual bug reporting platform that allows website owners to collect feedback from their users. The Service includes:

  • An embeddable feedback widget for websites
  • A Chrome browser extension for bug reporting
  • A dashboard for managing and viewing feedback
  • Integration capabilities with third-party services

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account

You must be at least 18 years old to create an account. If you are creating an account on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malware, viruses, or harmful code
  • Collect personal data without proper consent
  • Send spam or unsolicited communications
  • Interfere with the Service's operation or security
  • Attempt to access accounts or data belonging to others
  • Use the Service for competitive analysis or reverse engineering

5. User Content

You retain ownership of any content you submit through the Service ("User Content"). By submitting User Content, you grant Bugfeed a worldwide, non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing the Service.

You are responsible for ensuring you have the right to submit any User Content and that it does not violate these Terms or any applicable laws.

6. Subscription Plans & Payment

Bugfeed offers both free and paid subscription plans. For paid plans:

  • Fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise stated
  • We reserve the right to modify pricing with 30 days notice
  • You are responsible for all applicable taxes

Free plan accounts that remain inactive for 12 months may be deleted along with associated data.

7. Data Retention

Data retention varies by subscription plan:

  • Free: Feedback retained for 30 days
  • Pro: Feedback retained permanently during subscription
  • Business: Feedback retained permanently during subscription

Upon account deletion or subscription cancellation, your data will be deleted within 30 days unless required by law to retain it longer.

8. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by Bugfeed and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Third-Party Services

The Service may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of third-party services. Your use of such services is governed by their respective terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUGFEED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Bugfeed and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Service will immediately cease, and we may delete your account and data.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
